Terms of Service
These terms govern the use of Locaplex, the local SEO platform provided by Otospex Solutions LLC. By creating an account or using the service, you accept these terms on your own behalf and on behalf of the business you represent.
Who provides the service
Locaplex is provided by Otospex Solutions LLC, 1209 Mountain Road Pl NE Ste R, Albuquerque, NM 87110, United States. You can reach us at admin@locaplex.com. Privacy matters are handled at privacy@locaplex.com, as described in the Privacy Policy.
The service
Locaplex provides tools for local SEO operations, including Google Business Profile connections, review management with AI-assisted reply drafting, rank tracking, citations, audits, surveys and engagement links, content, and media. Features may evolve as the product develops. Any paid plan, usage limit, or separate order is communicated before a charge is made, and price or plan changes for paid subscriptions are announced in advance.
Accounts and access
You must provide accurate account information, keep credentials confidential, and use the service only if you have authority to act for the businesses, accounts, and locations you connect. Account owners are responsible for invitations, roles, user activity, and promptly removing access that is no longer authorized.
Acceptable use
Do not use Locaplex to break the law, violate another person's rights, send spam, publish deceptive or harmful material, interfere with the service, bypass security or usage controls, probe another tenant's data, introduce malicious code, or access third-party systems without permission. Automated use must respect documented interfaces and provider rules.
Your content and permissions
You retain ownership of content and data you submit. You grant Locaplex the limited permission needed to host, process, transform, and transmit that material to provide the features you request. You are responsible for having the rights, notices, and lawful basis needed for reviews, survey content, responses, media, and other submitted data.
AI and third-party services
Google, DataForSEO, email, monitoring, hosting, and AI services have their own terms and availability. You must follow the terms that apply to accounts you connect. AI output may be incomplete, inaccurate, or unsuitable; review it before publication or operational use. Locaplex does not guarantee rankings, reviews, revenue, or other business outcomes.
Availability and changes
We aim to operate the service reliably, but maintenance, provider outages, security events, and product changes may interrupt access. Features may be added, modified, limited, or retired. We communicate material changes that affect active users through the service or by email where practical.
Suspension and termination
You may stop using the service and request account closure at any time. We may suspend or end access when reasonably necessary to protect users or the service, respond to legal requirements, address non-payment under an agreed paid plan, or investigate a serious breach of these terms. Data handling after closure follows the Privacy Policy and applicable law.
Disclaimers
The service is provided "as is" and "as available". To the extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, and we do not promise that the service will be uninterrupted or error-free. You remain responsible for business decisions, published content, connected accounts, and compliance with platform rules and law. Nothing in these terms excludes rights that cannot be excluded by law, including mandatory consumer rights.
Limitation of liability
To the extent permitted by law, Otospex Solutions LLC is not liable for indirect or consequential losses, loss of profits, revenue, data, or goodwill, or for damage caused by third-party services, and our total liability arising out of or relating to the service in any twelve-month period is limited to the amounts you paid for the service during that period or, if you have paid nothing, to USD 100. Nothing in these terms limits liability for intent or gross negligence, for death or personal injury, or for any other liability that cannot lawfully be limited.
Governing law and disputes
These terms and any dispute arising out of or relating to them are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-laws principles. The state and federal courts located in Albuquerque, New Mexico have jurisdiction over any such dispute, and you consent to their jurisdiction and venue, without prejudice to mandatory consumer protections that let you bring or defend claims where you live. Before starting a formal dispute, contact admin@locaplex.com — most issues can be resolved directly.
Changes and contact
These terms are effective as of 14 August 2026 and replace all earlier versions. We may update them as the service evolves; we announce material changes in the application or by email at least 14 days before they take effect where practical, and continued use after the effective date constitutes acceptance where law permits.
